Injured In An Airplane Accident?

We all love the convenience of airplane travel. In just a few hours you can travel to another part of the world. This isn’t without risk, however, and airplane accidents can cause serious injuries or even death.

There are many causes of an airplane accident, but if it is due to the negligence of another party, injured parties may be entitled to financial compensation.

Who is responsible?

Airlines have a high duty of care that they owe to their passengers. They must take extra precautions to ensure that their employees are not responsible for any negligence that causes injuries to passengers.

If a passenger is injured due to human error, on the part of the airline crew, then the airline may be liable. If a passenger is injured due to outside or unforeseen forces, then an airline cannot be held liable.

An airline cannot guarantee a passenger’s safety. Taking an airplane trip is a risk, but an airline must exercise care from the time the passenger boards the plane to the time they disembark, to provide a safe passage. Airline crews are responsible for maintaining proper airline operation, keeping on top of inspections, and conducting safe loading procedures.

If a pilot does not follow proper procedures, they also may be held liable. An airline pilot is responsible for checking the weather and determining if it is safe to fly. If it is not, they may delay the flight. If they ignore safety protocol and fly anyways, and turbulence causes a serious accident, they may be held liable for that passenger’s injuries. A pilot may also be liable for injuries if they fly while intoxicated, or if they make an error that a typical pilot who was exercising reasonable care would not make, then they also may be held liable.

Even if a passenger is injured during a flight because of a human error, the liability doesn’t always fall on the airline. If the accident is due to a product defect, then the manufacturer may be responsible.

Ground crews may also be found negligent if they skip or miss inspecting parts of the aircraft.

If a passenger suffered injuries from an accident onboard a flight and they can prove it was the airline’s negligence, they may be entitled to financial compensation. They could be rewarded damages that cover medical expenses, lost wages, and emotional distress.
