A new class-action lawsuit against Bird and Lime accuse the e-scooter companies of “aiding and abetting assault” and “gross negligence”.
The e-scooter trend has led to an entire industry sprouting up in the matter of months. With it has come a host of issues including the rise of injuries and collisions.
A class-action lawsuit against the e-scooter companies and the manufacturers has been filed in Los Angeles County Superior Court, in October, on behalf of eight plaintiffs.
The lawsuit alleges that the companies should have known that their scooters would become a “public nuisance” when people drop them off wherever they please without appropriate warning. The e-scooters are often “dumped” casually wherever the rider feels like it or wherever the e-scooter’s battery runs out, this often means that they’re left on public sidewalks, in front of shops, and on private residential lawns.
It alleges that the scooter companies were aware of the dangers of their scooters and that the riders were assaulting and injuring pedestrians when they collided and therefore “assisted” scooters in assault.
Lastly, it claims that the devices contained defective parts and inadequate safety instructions.
The plaintiffs argue that the e-scooters have caused the public to suffer avoidable injuries to their person as well as their property.
Many cities across Southern California have already banned the e-scooters. The companies, however, argue that the e-scooters are an important alternative to cars and transportation, helping hundreds of millions of short car rides.
The lawsuit seeks to stop the deployment of e-scooters in California, it seeks damages, and it seeks more adequate instructions on the devices and apps.
