Were you injured in an accident, such as a slip and fall, construction accident, or car accident, because of the negligence of another party? If another party acted negligently and those actions led to your injuries, you may be entitled to damages.
In a personal injury case, a plaintiff may be awarded compensatory damages. Compensatory damages is a monetary award that is meant to make the plaintiff close to whole again. Compensatory damages put a monetary number on the cost of the accident. This award typically covers the costs of medical expenses, loss of income, loss of future earning potential, damage or loss of personal property, and pain and suffering. While medical expenses, loss of past and future income, and loss of property are all easily quantifiable expenses, putting a monetary price on pain and suffering is more difficult and more subjective.
In some cases, where the actions of the defendant were particularly egregious, a judge may award the plaintiff punitive damages. These are in addition to compensatory damages. The point of punitive damages is essentially to try deter future egregious acts of negligence by punishing the defendant and awarding more money to the plaintiff.
Damages may be reduced if the court finds that the plaintiff acted comparatively negligent. If the plaintiff was at fault in any degree, that will typically be reflected in the damages awarded to them. The court will also lower damages if they find that the plaintiff made no attempt to mitigate damages. For example, if they did not seek medical treatment for a month and that made their injuries worse and their medical expenses higher, the court will reduce damages awarded because the plaintiff had a reasonable expectation to seek out immediate medical treatment.
