What are the most common alcohol related injuries and who’s liable?
The most common alcohol related injuries include:
- Car accidents
Drunk driving is one of the top causes of major bodily injuries. Liability typically falls on the drunk driver. Victims of drunk driving can prove liability in court with a blood alcohol level report. The driver who drove under the influence, may in some cases, prove that the server at the bar they attended was negligent in serving alcohol to an intoxicated person. These cases strongly depend on local and state laws.
- Drowning
Drinking around the pool area is a major cause of accidents that can lead to drowning. Drowning doesn’t necessarily have to cause death, it can also result in brain injuries. People who drink around pools are more likely to slip and fall in or near the pool, especially if the floor area surrounding the pool is wet. The brightness of the sun may also play a factor in causing injuries in conjunction with drinking. Depending on whether the accident occurred at home or in a commercial area, liability is different. If the accident occurred at a private pool that contained a bar, the injured party may be able to prove if evidence is available that either the bar tender was negligent in serving too much alcohol, or that the owners were negligent when it came to providing a safe environment.
- Slipping and falling
Drinking alcohol dulls the senses and increases the chances of a person slipping and falling on sidewalks, around pools, or down stairs. A liability and negligence claim could be made if the owner of the premises was negligent in providing a safe environment.
- Domestic violence
Domestic violence is an unfortunate reality throughout the U.S. and alcohol consumption only makes those who are already likely to cause violence much worse. With evidence, victims may be entitled to compensation for their injuries from their domestic abusers.
